ATLASFlow CRM – Terms of Service

Welcome to ATLASFlow CRM (“ATLASFlow,” “ATLAS,” “Company,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of:

  • The ATLASFlow CRM platform

  • The ATLASFlow website (atlasflowcrm.com and any subdomains)

  • Any lead generation, AI automation, sales automation, software, dashboards, content, or related services provided by ATLASFlow (collectively, the “Services”).

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree, do not use ATLASFlow.

1. Eligibility

To use ATLASFlow, you must:

  • Be at least 18 years old

  • Have the legal authority to enter into a binding contract

  • Use the Services for business purposes only (B2B SaaS + agency hybrid model)

ATLASFlow is not intended for personal or consumer use.

2. Description of Services

ATLASFlow provides a combination of:

  • SaaS CRM software

  • AI-powered sales automation

  • AI appointment-setting and lead follow-up

  • Marketing analytics and reporting

  • Lead capture and lead management tools

  • Sales pipeline management

  • Business automation tools

  • Optional lead generation / agency services

  • Email, SMS, and phone service integrations

  • Dashboard tools for revenue, ROAS, scheduling, and job tracking

ATLASFlow may add, modify, or remove features at any time.

3. User Accounts

You are responsible for:

  • Keeping your login credentials secure

  • Maintaining accurate account information

  • Any activity conducted under your account

You must not share login access outside your organization.

If you believe your account has been compromised, contact us immediately at support@atlasflowcrm.com.

4. Subscription, Pricing & Payment

4.1 Subscription Fees

ATLASFlow Services may be offered through:

  • Monthly subscriptions

  • Annual subscriptions

  • Founders Circle packages

  • One-time onboarding or setup fees

  • Add-on services (e.g., agency-level lead generation)

All pricing is listed on the website or in your service agreement.

4.2 Payment Authorization

By subscribing, you authorize ATLASFlow and its payment processors to:

  • Charge your payment method on a recurring basis

  • Automatically renew your subscription unless canceled

4.3 No Refunds Policy

Unless explicitly stated otherwise in writing:

  • All payments are non-refundable.

  • Subscription fees are non-refundable, including partial billing periods.

  • Cancelation only prevents future charges.

4.4 Failed Payments

If payment fails:

  • Your account may be suspended or terminated.

  • ATLAS may attempt to re-run failed payments.

5. Cancelation & Termination

5.1 Cancelation

You may cancel at any time through:

Cancelation must occur before the next billing cycle to avoid charges.

5.2 Termination by ATLASFlow

We reserve the right to terminate or suspend access for:

  • Violations of these Terms

  • Fraudulent, abusive, or harmful activity

  • Non-payment

  • Misuse of the Services

Terminated accounts are not entitled to refunds.

6. Acceptable Use Policy

You agree NOT to use ATLASFlow to:

  • Violate laws or regulations (TCPA, CAN-SPAM, CASL, GDPR, etc.)

  • Spam, misuse SMS/email tools, or send unsolicited messages

  • Upload harmful code, bots, scrapers, or malware

  • Harass or exploit individuals

  • Attempt to reverse-engineer the platform

  • Interfere with ATLASFlow’s systems or servers

  • Misrepresent your identity or business

Violations may result in immediate account termination.

7. AI Features & Disclaimers

ATLASFlow may provide:

  • AI-generated messaging

  • AI sales follow-up

  • AI appointment-setting

  • AI lead scoring

  • AI summaries and recommendations

You acknowledge and agree that:

  • AI may produce inaccurate or incomplete information

  • You are responsible for reviewing and approving any AI-generated messages before sending

  • ATLASFlow is not liable for decisions you make based on AI suggestions

You must ensure AI usage complies with:

  • TCPA

  • CAN-SPAM

  • Local telemarketing laws

  • All applicable regulations

8. Lead Generation & Performance Disclaimer

If you use ATLASFlow lead generation services:

  • Results vary per market, budget, offer, and competition

  • ATLASFlow does not guarantee any specific number of leads, appointments, or closed deals

  • Performance-based statements are estimates only, not guarantees

You are responsible for:

  • Closing your leads

  • Following up (including where AI is used)

  • Providing a competitive product or service

9. Data Processing & Privacy

Use of the Services is also governed by our Privacy Policy.
By using ATLASFlow, you consent to data collection and analytics practices described in that policy.

ATLASFlow may store and process data related to:

  • Leads

  • Contacts

  • Appointments

  • User behavior

  • Ad performance

  • CRM activity

  • Emails, calls, and SMS (when integrated)

You represent that you have proper consent from your contacts to store and process their data.

10. Third-Party Integrations

ATLASFlow integrates with services such as:

  • Meta (Facebook/Instagram)

  • Google Ads / Google Analytics

  • LinkedIn

  • YouTube

  • Twilio

  • Stripe

  • Zapier

  • Klaviyo

  • Calendars and email providers

ATLASFlow is not responsible for:

  • Availability or downtime of third-party platforms

  • Data loss caused by third-party systems

  • Changes to third-party APIs or features

Your use of third-party integrations is subject to their terms.

11. Intellectual Property

All ATLASFlow materials—including software, dashboards, designs, trademarks, logos, content, and AI systems—are the exclusive property of ATLASFlow.

You may not:

  • Copy

  • Reproduce

  • Resell

  • Distribute

  • Create derivative works

  • Frame or clone the platform

Use beyond what is permitted in these Terms is strictly prohibited.

12. Confidentiality

Any private business information shared between you and ATLASFlow—including campaign data, CRM access, strategies, or internal documents—is confidential.

You agree not to disclose such information to third parties.

13. Limitation of Liability

To the fullest extent permitted by law:

  • ATLASFlow is not liable for lost profits, lost revenue, data loss, business interruption, or punitive damages

  • ATLASFlow liability is limited to the amount you paid in the last 3 months

  • Services are provided “as-is” and “as available”

We do not guarantee:

  • Specific results

  • Lead quality

  • Platform uptime

  • Accuracy of AI-generated outputs

  • Compatibility with your systems or processes

14. Indemnification

You agree to indemnify and hold ATLASFlow harmless from any claims arising from:

  • Your use of the Services

  • Illegal or improper messaging (SMS/email/TCPA violations)

  • Misuse of AI or automation

  • Violation of these Terms

  • Any business activities or liabilities connected to your leads, clients, or operations

15. Modifications to Terms

ATLASFlow may update these Terms at any time.
Continued use of the Services constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of:

Alberta, Canada
(or your specific jurisdiction if preferred)

Any disputes must be resolved in the courts of Alberta unless otherwise agreed.
